Satyen Vaidya, Judge (Oral). Notice. Ms. Menka Raj Chauhan, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents.
2. Petitioner retired as Class-III employee. He has been denied the pension for not satisfying the condition of minimum required length of service. Petitioner seeks counting of his daily wage service towards qualifying service for the purpose of pension and pensionary benefits. The claim has been made on the strength of decision rendered in Roop Lal vs. State of H.P. & Ors., LPA No.196 of 2022, decided on 1 Whether reporters of the local papers may be allowed to see the judgment?
2 ( 2025:HHC:28502 ) 11.10.2023 [SLP (C) No.1007/2024] instituted by the State against the aforesaid decision has been dismissed by the Hon’ble Apex Court on 18.03.2025.
3. In view of above, this writ petition is disposed of by directing the respondents to consider the case of the petitioner for grant of pension in light of decision rendered in Roop Lal’s case (supra) within a period of six weeks from today. The order so passed be also communicated to the petitioner.
4. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
