2. The petitioner is apprehending his arrest in connection with Complaint Case No.1547 of 2023 for the alleged offences registered under Sections 498A, 323, 504, 506 and 34 of Indian Penal Code, pending in the Court of learned Sub-Divisional Judicial Magistrate, Garhwa.

Learned counsel appearing for the petitioner submits that the petitioner is the husband of the informant and the case has been registered under Section 498A of Indian Penal Code and Section 4 of Dowry Prohibition Act. He submits that there are general and omnibus allegation against all the family members and

further allegation made against the petitioner is that on 4th September, 2023 the petitioner has assaulted the informant.

Learned counsel appearing for the State opposes the prayer and submits that the petitioner is the husband and the allegations are there against the petitioner of assault.

Considering that the petitioner is the husband and there are general and omnibus allegation against the petitioner and further allegation is made against the petitioner of assault and there is no injury and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
