PUBLIC PROSECUTOR (AP) The Court made the following: ORDER:- This Criminal Revision Case under Sections 397 & 401 of Cr.P.C., is filed aggrieved by the order dated 07.03.2015 passed by the learned Judicial Magistrate of First Class, Kanigiri, in C.F.R.No.2887/2011. 2. Heard. Perused the entire material on record. 3. A perusal of the orders passed in C.F.R.No.2887 of 2011 goes to show that protest petition filed by the de-facto complainant is dismissed. In the said petition, learned Judicial Magistrate of First Class, Kanigiri, framed question for consideration as to ‘whether the C.F.R. is cognizable and can be registered as a Calendar Case’?. After considering the material placed on record, learned Judicial Magistrate of First Class, Kanigiri, dismissed the petition. 4. Learned Assistant Public Prosecutor submits that according to his instructions, the revision petitioner is no more. Learned Assistant Public Prosecutor also placed the copy of report enclosing death certificate of the de-facto complainant submitted by the Sub- Inspector of Police. 5. Considering the report submitted and on account of the death of the de- facto complainant/petitioner, this Court feels that the cause does not survive. Nonetheless, as per the death certificate, the de-facto complainant died on 20.3.2019 and no steps have been taken by the legal representatives. It appears that they also have no interest to prosecute the matter. 6. Accordingly, the Criminal Revision Case is dismissed for non- prosecution.
