2 / 2 10.1 That, this Hon’ble Court may kindly be pleased to call the entire records pertaining to case of petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, thereby quashing the impugned notice dated 07.05.2025 (Annexure P/1) and further be pleased to direct the respondent authorities not to take any coercive action against the petitioner for removal from the subject land. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.
2. At the very outset learned counsel for the petitioner contended that the shop/construction over the encroached government land be removed by the petitioner itself within next 10 days from today.
3. In this regard learned counsel for Respondent No.2 has not opposed the request made by the petitioner.
4. In view of the above, the instant writ petition is disposed of with a direction to the petitioner to remove the shop/construction over the encroached government land within 10 days from today, failing which the Respondent No.2 shall be free to proceed in accordance with law for removing the said construction.
