PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/AI, seeking bail, in Crime No.57/2025 of Gafu\^ka police station, Visakhapatnam Commissionerate. 2 1% A case has been registered against the petitioner and others for the offence punishable u/Sec.8(c) r/w Sec.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act. 2. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Case of the prosecution, in brief, is that, on 11.02,2025 at 7.00am, 4. on receipt of credible information regarding illegal possession and transportation of ganja, the S.l of police, along with his staff and mediators rushed behind more super market, VUDA colony, Kanithi Road, Gajuwaka and went to the house of the petitioner/AI for search. On seeing police, the inmates in the house who are eight in number tried to escape. Then police apprehended them and on enquiry, they disclosed their identity particulars as that of A1 to A8 and police found 184 kgs of ganja in their possession. Then police apprehended them and seized the ganja and after observing all formalities, they were remanded to judicial custody. 5. Heard. Perused the record. Learned Assistant Public Prosecutor submits that the contraband 6. involved is huge quantity i.e. 184 kgs and investigation is not completed and some more witnesses are to be examined and prays to dismiss the criminal petition. 3 Learned counsel for the petitioner contend that the petitioner was 7. arrested on 11.02.2025 and since then he has been languishing in jail and prays to allow the petition. After careful observation of the material on record and submissions 8. made on behalf of both sides, as the contraband involved in this crime is huge quantity i.e. 184 kgs and as the petitioner has been remanded to judicial custody on 11.02.2025 itself and the allegations made against the petitioner are grave in nature, this Court is not inclined to consider the criminal petition at this stage.
