JUSTICE KAKHETO SEMA ORDER Date : 20-03-2025 Heard Mr. Imti Imsong, learned Addl. Advocate General for the applicant. The present application has been filed by the State of Nagaland represented by the Special Secretary to the Government of Nagaland, department of Home, Nagaland, Kohima, praying for extension of time for Page No.# 17/20 compliance of the direction passed in the judgment & order dated 26/09/2024 in W.P.(C) No. 318/2023. Paragraph-15 of the judgment & order dated 26/09/2024 inter-alia reads as under; “15. In the above facts and circumstances obtaining in the case in hand, the present writ petition is disposed of with the following observations and directions. [i] The appointments of the respondents, that is, of the respondent nos. 20 to 73 and the respondent nos. 75 to 183, challenged in the writ petition, to the post of Constables who were appointed during the period from January, 2018 to September, 2020 by the State respondent authorities without any advertisement are all set aside and quashed. The appointment orders enclosed as Annexure-B to B-53 and Annexure-B-55 to B- 183 are set aside and quashed. [ii] As the respondent no. 74 is found to have been appointed in a post of Constable [GD] against an existing vacancy on compassionate ground vide an Order of Appointment dated 21.11.2019 [Annexure-B-54], no interference is made in respect of the appointment of the respondent no. 74. [iii] The State respondents are directed to take steps for holding fresh selection of the posts of Constables, which become vacant due to setting aside and quashing of the orders of appointment issued in respect of the respondent nos. 20 to 73 and the respondent nos. 75 to 183, by issuance of advertisement in newspapers which are widely circulated throughout the State of Nagaland. The said selection be held in accordance with law. It is further observed that the process of recruitment shall be conducted following the principles enshrined in Article 14 and Article 16 of the Constitution of India. [iv] The process of selection shall be completed at the earliest and preferably within 6 [six] months from the date of the Page No.# 18/20 present order. [v] The respondent nos. 20 to 73 and the respondent nos. 75 to 183 herein whose appointments have been set aside by this judgment would be eligible to participate in the fresh selection process. [vi] The upper age limit of the respondent nos. 20 to 73 and the respondent nos. 75 to 183 as well as the petitioners herein shall be given relaxation. However, there shall be no relaxation in the matter of basic qualifications as well as the Departmental physical criteria. As held in the common Judgment and order dated 20.09.2024 [supra] that there shall be no concession/relaxation as sought for in terms with Annexure-A of the affidavit filed by the State of Nagaland on 20.08.2024 in the batch of writ petitions, W.P.[C] no. 189/2022 to W.P.[C] no. 199/2022, this Court likes to observe in similar manner, though the affidavit dated 20.08.2024 is not part of the records of this case. [vii] The respondent nos. 20 to 73 and the respondent nos. 75 to 183 may be allowed by the State respondents to continue in-service for a period of 6 [six] months from the date of the instant order or till such time fresh appointments are made pursuant to the selection directed hereinabove, whichever is earlier. [viii] It is further observed that during the continuance of service of the respondent nos. 20 to 73 and the respondent nos. 75 to 183 as observed in para [vii] above, they are required to maintain discipline required on the part of the members of the Nagaland Police Force and in case of any act of indiscipline on their part, the State respondent authorities would be at liberty to deal with such act of indiscipline in accordance with law.” Mr. Imti Imsong, learned Addl. Advocate General has referred to the paragraph-4 of the application which reads as under; Page No.# 19/20 “4. That it is further respectfully submitted that the Department has been taking steps in earnest to comply with the direction of this Hon'ble Court, but considering the ponderous administrative process involved, it is unable to meet the dateline of 6 (six) months set by the Hon'ble Court, which shall expire by the end of March, 2025, and faced with the impending prospect of contempt proceeding unless the Hon'ble court is pleased to grant further extension of time in the interest of justice.” It is accordingly submitted that in view of the cumbersome process involved to complete the process of recruitment of the numerous posts of Constable, the State is not able to comply with the judgment & order dated 26/09/2024 within the time framed by the Court. The learned Addl. Advocate General therefore, submits that another 6(six) months time may be granted to the State to complete the process of recruitment as directed by this Court in the judgment & order dated 26/09/2024. Ms. Z.Zhimomi, learned counsel appears for the respondents/petitioner No. 1 to 11 and vehemently objects to the submission made by the learned Addl. Advocate General for extension of time to comply with the judgment & order dated 26/09/2024. She also seeks for 10 days time to file written objection. The judgment & order was passed on 26/09/2024 and the 6(six) months period for complying with the said judgment & order more particularly, to complete the selection process to the post of Constables shall end by 26/03/2025. This Court has taken into consideration the submission made by the learned Addl. Advocate General that the Government is earnestly taking steps to comply with the direction passed by this Court however, in view of the ponderous administrative process involved, it is unable to meet the dateline of 6(six) months set forth by this Hon’ble Court. Page No.# 20/20 This Court has also taken into consideration the objection raised by the learned counsel for the respondents/petitioners and this Court is of the view that allowing 10 days time to the respondents/petitioners to file objection will frustrate the application itself. On consideration of the submission made by the learned counsel for the parties and also taking into account that the State is taking steps to comply with the direction passed by this Court. This Court, in the interest of justice, is inclined to grant another 4(four) months time to the State/applicant to complete the process of selection as directed by this Court in the judgment & order dated 26/09/2024. The 4(four) months time shall commence from the date of this order. The extension of 4(four) months time is granted only for enabling the State/applicant to complete the selection process for recruitment to the post of Constables. All the other directions passed in the judgment & order dated 26/09/2024 shall remain intact. It is also made abundantly clear that no further extension of time shall be granted to the State for completing the recruitment process to the post of Constables in the Nagaland Police department.
