This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicants who have been arrested in connection with Crime No.17/2025 registered at Police Station Gudhiyari, Distt. Case of the prosecution, in brief, is that Complainant Umakant Verma, a Grade-2 employee at Loco Shed in Bilaspur, lodged a complaint stating that between 17.03.2024, and 27.09.2024, he was deceived by 2 unknown accused person through WhatsApp messages from mobile number 9690047185. The accused promised Verma that he could earn money by performing tasks, such as liking Amazon products, and receiving Rs. 50 cashback per like along with a 30% profit on prepaid tasks. Mr. Verma allegedly lost Rs. 50,00,000/- across different accounts and dates. Following the investigation, the police filed a charge-sheet. The allegation against the applicants is that, at the behest of one Amit Dewangan, they sold their bank account and received Rs. 2 to 3 thousand from them. Hence the FIR. 3. Learned counsel for the applicants submits that the applicants are innocent and they have been falsely implicated in this case. He would submit that bail application of one of the co-accused person namely Gopal Agrawal has been rejected by this Court in MCRC No.3524/2025 on 07.05.2025. He would submit that the applicants belong to Below Poverty Line (BPL) card holder and moreover they are illiterate villages, who have been deceived by other co- accused person and sold their bank accounts for Rs. 500/-. He would submit that the applicants have no previous criminal antecedents, applicant No.1 is in jail since 5/02/2025 and applicant No.2 is in jail since 24/03/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicants. 4. On the other hand, learned State Counsel opposes the bail application. He would submit that allegation against the applicants is that, at the 3 behest of one Amit Dewangan, they sold their bank account and received Rs.2 to 3 thousand from them, thereby the applicants participated in online fraud, hence they are not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, also considering the nature of allegation levelled against the applicants that they sold their bank account in lieu of money, thereby the applicants participated in online fraud and also considering the fact that bail application of one of the co-accused person namely Gopal Agrawal has been rejected by this Court in MCRC No.3524/2025 on 07.05.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, the bail application of applicant No.1- Sandeep Sahu and applicant No.2 Chandrashekhar Sahu involved in Crime No.17/2025 registered at Police Station Gudhiyari, Distt. Raipur (C.G.) for the offence punishable under Sections 318(4), 111, 3(5) of B.N.S. 2023 is rejected. 8.
