Learned counsel for petitioners submits that petitioners are arrayed as an accused in Cr.No.147 of 2025 on the file of Kuppam Police Station, Chittoor District for the alleged offences under sections 109(1), 351(2) read with 3(5) of the BNS. Learned counsel for the petitioners submits that the f petitioners and respondent No.2 are all relatives and the dispute is with regard to the water pipeline. It is alleged in the complaint that the petitioners have drawn water from the pipeline which has reduced the pressure of water to the respondent No.2 and in that there has been an altercation and a complaint was filed in that regard.

Learned counsel for petitioners further submits that the petitioners have drawn the water from the municipal connection only and even as per the complaint, it is evident that respondent No.2 refers to the dispute pending between the petitioners’ family and respondent No.2. It is submitted that no injuries were caused to respondent No.2. However, the complaintwas lodged by alleging offences under sections 109(1), 351 (2) read with 3(5) of the BNS.
3. On considering the above facts and circumstances, it is clear that Section 109(1) of the BNS is not applicable to the present case and therefore.

this court is inclined to dispose of this criminal petition by directing respondent No.1 to complete the investigation in Cr.No.147 of 2025 of Kuppam Police Station, Chittoor District, without taking any coercive steps against the petitioners. This would not preclude the Station House Officer from filing final report/charge sheet after investigation of crime. As a sequel, miscellaneous petitions, pending, if any, shall stand closed.
