21.05.2025 Item No.24 Ct.No.34 rc. C.R.M. (M) 381 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pandua Police Station Case No. 546 of 2023 dated 02.10.2023. And In Re : Gobinda Mallick ... Petitioner. Mr. Suman Chakraborty ... for the Petitioner Ms. Amita Gaur Ms. Ranjavati Das ... for the State The petitioner is in custody for more than a year and prays for bail. Learned counsel for the petitioner submits that the petitioner seeks parity with the co-accused who are on bail. Learned counsel for the State opposes the prayer. It appears that the petitioner has been identified in Test Identification Parade. He has ten criminal antecedents to his credit. He is not similarly circumstanced with the co- accused who were not part of the decoity. Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The application is disposed of. Case Diary be returned. 2 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
