HABC No.37 of 2025 Hon’ble Ravindra Maithani, J. Hon’ble Siddhartha Sah, J. None appeared for the petitioner. Mr. J.S. Virk, Deputy Advocate General with Mr. Rakesh Joshi, Brief Holder for the State. This is a habeas corpus petition. According to the petitioner, his sister has been illegally confined by the respondent no.3/Rajat Kumar. The petitioner had already lodged her missing report. On 25.02.2026, when the matter was taken up, learned State Counsel had submitted that the police called the sister of the petitioner as well as the petitioner at the police station, where, the sister of the petitioner had categorically stated that she is 19 years of age and she wants to stay with the respondent no.3/Rajat Kumar. She does not want to stay with the petitioner. Upon this submission having been made on 25.02.2026, learned counsel for the petitioner had sought time to get instructions. But, today none represents the petitioner. Since on the very first date, it was told to the Court that corpus is staying separate on her own free will. This has not been rebutted by the petitioner. Therefore, nothing survives in this petition. It stands disposed of accordingly.
