POONACHA ORAL ORDER The present writ petition is filed by respondent No.4 in FDP.No.3/2007 calling in question the order dated 06.03.2024 whereunder IA.No.3/2023 is filed by respondent No.4 in FDP.No.3/2007 has been rejected. 2. The relevant facts are that respondent No.1 instituted a suit in OS.No.4111/1987 which was decreed on 23.11.2006. FDP.No.3/2007 was filed by respondent No.1 to draw final decree in terms of the decree passed in the suit. IA.No.4/2022 was filed by respondent No.1/ petitioner to permitted her to purchase shares of other shareholders as per the market value. Vide order dated 21.09.2022 the Trial Court allowed the said application, permitted respondent No.1/petitioner to purchase the shares of the other shareholders as per the market value and further ordered that in the event respondent No.1/petitioner fails to purchase the shares as per IA.No.4, the property be sold through public sale and the sale proceeds distributed amongst the shareholders in - 6 - NC: 2025:KHC:13184 WP No. 13330 of 2024 terms of the decree dated 31.03.2004 passed in OS.No.4111/1987. Thereafter, the petitioner herein who is respondent No.4 in the final decree proceedings filed IA.No.3/2023. The Trial Court vide order dated 06.03.2024 dismissed the said application. Being aggrieved the present writ petition is filed. 3. It is the vehement contention of learned counsel for the petitioner that the petitioner/respondent No.4 is in possession of portion of property and she is entitled to seek to purchase the shares of the other shareholders of the property in which she is in possession. 4. It is relevant to note that the application filed by the petitioner/respondent No.1 in IA.No.4/2022 to permit her to purchase the shares of the other shareholders has been allowed by the Trial Court vide order dated 21.09.2022. When respondent No.1 / petitioner has filed IA.No.4/2022, petitioner/ respondent No.4 did not file any objection to the said application. Subsequently, the order dated 21.09.2022 passed on IA.No.4/2022 was called in question by the other - 7 - NC: 2025:KHC:13184 WP No. 13330 of 2024 respondents in WP.No.235015/2022. The said order dated 21.09.2022 was not challenged by petitioner/respondent No.4. 5. It is submitted by the learned counsel appearing for respondent No.1/ petitioner that consequent to the order dated 21.09.2022 respondent No.1/ petitioner has already deposited the value according to the value of the property offered by her before the Trial Court. 6. The Trial Court has rightly noticed that IA.No.4/2022 was not objected to by respondent No.4 nor was the order dated 21.09.2022 allowing IA.No.4/2022 challenged by respondent No.4, the question of favorably considering IA.No.3/2023 filed by respondent No.4 does not arise. The petitioner has failed in demonstrating that the order dated 06.03.2024 passed by the Trial Court is any manner erroneous and liable to be interfered with by this Court in the present writ petition. 7. In the event respondent No.1/petitioner fails to purchase the property in terms of the order dated 21.09.2022 passed on IA.No.4/2022, it is open for the petitioner herein to seek for enforcement of his rights, in accordance with law. - 8 - NC: 2025:KHC:13184 WP No. 13330 of 2024 8.
