[2025:RJ-JP:25733] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 9995/2025 Shreeji Govans Gaushala, Diggi, Tehsil Malpura, District Tonk Through President Avdesh Shrma S/o Late Shri Siyaram Sharma, Aged 39 Yers, R/o Diggi, Tehsil Malpura, District Tonk. ----Petitioner/Objector Versus 1. State Of Rajasthan, Through Secretary Gopalan Department, Govt. Of Rajasthan, Secretariat, Jaipur. 2. Director, Gopalan Department, Rajasthan, Secretariat, Jaipur. 3. Joint Director, Animal Husbandry Department, Tonk And Member Secretary, District Level Gopalan Committee Tonk. 4. District Collector And President, District Level Gopalan Committee, Tonk. 5. Tehsildar, Tehsil Malpura District Tonk. ----Respondents For Petitioner(s) : Mr. Anil Sharma, Adv. HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 10/07/2025 1. The instant writ petition is listed in “to be mentioned category”. 2. By way of this writ petition, the petitioner - Shreeji Govans Gaushala through its President has challenged the order dated 13.06.2025 issued by the respondent No.3 whereby the petitioner Gaushala has been deprived off in getting Gaushala aid/financial assistance for second round of financial year 2024-25 for not [2025:RJ-JP:25733] (2 of 4) [CW-9995/2025] uploading of the physical verification report on Gopalan Web Application. 3. Heard. Perused the material available on record. 4. The order impugned dated 13.06.2025 clearly manifests that it was the inaction on the part of the officer of the respondent department i.e., Nayab Tehsildar, Diggi in conducting joint physical verification of the petitioner Gaushala along with concerned veterinary officer. In pursuance of the order dated 05.04.2025 issued by respondent No.1 Secretary, Gopalan Department, Govt. of Rajasthan, applications for grant of financial aid for second round for Financial Years 2024-25 were invited from the eligible Gaushalas by 19.05.2025 on Gopalan Web Application. Thereafter, a joint physical verification by the concerned Tehsildar and concerned veterinary doctor is to be done by 30.05.2025 and a report to this effect is also to be submitted in the Office. However, no physical verification of the petitioner Gaushala could be conducted by the scheduled date. Tehsildar, Malpura was repeatedly asked by the petitioner as well as the concerned veterinary doctor for conducting joint physical verification of the petitioner Gaushala but he did not turn up and on 30.05.2025, he nominated Nayab Tehsildar, Diggi for conducting joint physical verification along with the concerned veterinary doctor on 30.05.2025 itself and to submit report on the same day. But the said Nayab Tehsildar also remained reluctant and did not come forward for conducting physical verification of the petitioner Gaushala and for this reason, physical verification report could not [2025:RJ-JP:25733] (3 of 4) [CW-9995/2025] be uploaded on Gopalan Web Application and the petitioner Gaushala has been deprived from the relevant financial aid. 5. In these circumstances, there is nothing on record for which the petitioner Gaushala can be blamed for. The petitioner cannot be made suffer for the inaction on the part of the officers of the respondent Department. The respondents were under obligation to conduct physical verification of the petitioner Gaushala within the scheduled timeline and submit its report. However, due to lapse on the part of the officers of the respondent Department, same has not been conducted. Thus, without commenting anything on entitlement of the petitioner Gaushala for the financial aid, I deem it appropriate to dispose of the present writ petition with direction to the respondents to conduct physical verification of the petitioner Gaushala in terms of the relevant rules and scheme of the respondents by 22.07.2025 and submit its report physically with the Department as well as upload the same on Gopalan Web Application within three days thereafter. Upon receiving such report, the respondents are directed to decide and grant financial aid in favour of the petitioner Gaushala as per its entitlement in accordance with the rules and guidelines. It is reiterated here this Court has not passed any observation for entitlement or dis- entitlement of the petitioner Gaushala over financial aid. The petitioner would be free to approach the Court, if it is aggrieved by action/inaction of the respondents. This Court is not satisfied with the conduct of the concerned Tehsildar, Malpura and Nayab Tehsildar, Diggi as prima facie, it appears that both failed to discharge their duties properly. Accordingly, it is hereby directed [2025:RJ-JP:25733] (4 of 4) [CW-9995/2025] that for the lapses, as surfaced in this matter, explanation be sought from both these erring officials and after considering the explanation, appropriate steps be taken.
