Nos. 338 and 334 admeasuring Ac. 4.00 cents bounded on East: Land of Nagaiah, West: Road leading to Budili, South: Land of Chakala Nagappa and North: Land of Venkata Rammappa and Kamma Venkarayappa, situated in Mallapalli Revenue Village and GorantI Mandal, Sri Sathya Sai District, Erstwhile Anathapuramu District, without taking any steps for acquisition of the land and without giving any notice to the petitioner and in directing the petitioner to vacate the same and threatening the petitioner to dispossess from the aforementioned land as illegal, arbitrary without jurisdiction, contrary to due process of law and against to the principles of natural justice and consequently direct the respondents not to lay the road in the aforementioned land and not to dispossess the petitioner without adhering to due process of law and pass such other order. ” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for the official respondents. 3. Learned counsel for the petitioner submits that the petitioner purchased the subject property by way of registered sale deed dated 25.02.1991 from one Chakala Gangadharappa, S/o.Nanjappa and his wife Chennamma. Since, then the petitioner ft has been in peaceful possession and enjoyment of the subject property. Subsequently, recognizing the rights and possession of the petitioner over the subject property, a sub-division was effected in the month of May, 2022 and the petitioner was allotted an extent of Ac.1.87 in Sy.No.338-4D, an extent of Ac.2.13 cents in Sy.No.334-7. Pattadar pass book and title deed were also issued in favour of the petitioner and the name of the petitioner was mutated in the revenue records. While things stood thus, at the instance of respondent Nos.6 and 7, respondent Nos.3 to 5 has directed the petitioner to vacate the subject property on the ground that the subject land is required for laying of the road. He further submits that without initiating any acquisition proceedings, the respondents cannot lay any road in the subject land. Hence, the present Writ Petition. 4. On the other hand, learned Government Pleader for the official respondents submits that if the respondents intend to lay any road/pathway through the petitioner’s land, the respondents will follow due process of law. 5. Considering the submissions made by both the learned counsel, the Writ Petition is disposed of. However, the respondents are at liberty to proceed further, if any notified car track or pathway or Donka is identified/recorded through the petitioner’s land, by following due process of law.
