Angami, learned Sr. Government Advocate appearing on behalf of the respondent/contemner No.1 and Ms. V. Suokhrie, learned Addl. A.G for the State respondent/contem- nor Nos 2 to 5. This contempt application is filed under section 12 and 13 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for initiating contempt proceed- ing for willful and deliberate violation of the order of this Court dated 25.11.2021 passed in W.P.(C) 80/2020 wherein the re- spondents/contemners were directed to consider the case of the
Page No.# 3/3 present petitioner for grant of minimum scale of pay within a pe- riod of 3(three) months from the date of receipt of the order. In that context, Ms. V. Suokhrie, learned Addl. A.G submitted that the Government has already initiated the process for grant of scale of pay to all the work charged and casual em- ployees in all the Departments where names have already been verified and the case of the present petitioner will also accord- ingly be considered in view of the Office Memorandum No.AR- 3/GEN-67/2021 dated 05.03.2025. The learned Addl. A.G has also produced the copy of the Office Memorandum as well as the Notification dated 05.03.2025. In that context, Mr.
Likhase, learned counsel for the petitioner submitted that he has no objection in closing the present contempt petition if the case of the present petitioner is also considered in view of the Office memorandum as well as the Notification of the Government which has been produced by the learned Addl. A.G. In view of above, the present contempt petition is closed with a direction to the State respondents/contemners to consider the case of the present petitioner in pursuant to the Notification and the Office Memorandum dated 05.03.2025.
