Heard Ms. Obangnenla Longchar, learned counsel appearing on behalf of the applicant and Mr. Moa Imchen, learned Senior Government Advocate appearing on behalf of the respondents. This application has been filed under Section 5 of the Limitation Act, 1963 for condoning a delay of 165 (One Hundred Sixty Five) days in filing
Page No.# 4/4 the accompanying writ appeal against the Judgment and Order dated 28.08.2024, passed in WP(C)/206/2022. The counsel appearing on behalf of the respondents, Mr. Moa Imchen submits that taking into account the grounds which have been mentioned, the respondents would not object to the instant application. This Court, further also have taken note of the grounds which have been assigned in the application, more particularly, at paragraph nos. 6, 7 and 8 and is of the opinion that the said grounds constitute a sufficient cause within the meaning of Section 5 of the Limitation Act of 1963.
Considering the above, this Court condones the delay of 165 days in filing the accompanying writ appeal against the Judgment and Order dated 28.08.2024 passed in WP(C)/206/2022. The I.A. stands allowed. In view of the above Order passed, the delay being condoned, list the writ appeal for admission next week. JUDGE JUDGE Comparing Assistant
