N RAVI PRASAD COUNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER Dr. YLR, J Crl.P.No.6684 of 2025 Dated 14.07.2025 The Court made the following: ORDER.. ` \ .-The Criminal Petition has been filed under sectl'ons 437 and 439 of the'Code of criminal procedure,1973 (for brevity [the Cr.P.C.I)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ithe BNSSJ), seeking to enlarge the petitioner/Accused No.3 on bail in Cr.No.359 of 2024 of Airport Police Station, Visakhapatnam Commissionerate, registered against the petitioner/Accused No.3 herein for the offences punishable `under Sections 120-B, 420, 386, 307, 347, 328, 352, 506 read with 34 of fthe IPC', Section 67 of the Information Technology Act-2000-2008. 2. The case of the prosecution is that one Mohammed Azeem Khan lodged a report against Joy Jemima, Venu Reddy @ Chinna and her associates, stating that they conspired together with an intention to gain money and properties from the de-facto complainant by creating c!ecep{ion and threat under fear of death, and also blackmailed him by laying a trap in the guise of love with deceitful words. Accused No.1, with the help of others, used to provide intoxicated sprays and juices, and while in a drowsy state, took intimidating photos and laterifif€a{ened him and extorted huge money by putting fear of circulating those photos and videos to his family and friends. Accused No.1 forcibly took away valuable items belonging to i-ap-_-'ny_ _r_I:xp_se__: •€ _ 3 Dr. YLR, J Crl.P.No.6684 of 2025 Dated 14.07.2025 the cleiacto complainant, i.e., laptops, mobiles, jewellery,~-and' cash, all worth of Rs.25,00,000/-, and demanded to part with Rs.75,00,000/-. !t is also alleged by the de-facto compiainant that Accused No.1 lodged a missing complaint at Gopalapuram Police Station with allegations of sexual harassment against the de-facto complainant at Airport Police Station-. 3. Sri N. Ravi Prasad, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he was falsely imp'licated in this case; he is sole breadwinner of his family; he is ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 4. Per cot,ira, Mr.Neelotphal Ganji, the learned Assistant Public Prosecutor, opposed in granting of bail stating that the preliminary charge sheet was filed in this case; if the pet]tioner is enlarged on bail', he would not be available for the investigation and he would escape from the clutches of- law; and llrged to dismiss the bail petition. 5. Perused the record. | : 6. .As seen from the record, the petitioner has been in judicial custody for the past 36 days; he was remandec! {o judicial custody onl 18.05.2025. ln an earlier case in another crime, the petitioner was arrested on 18.05.2025, remanded to judicial custody, and was_ released on L_, iF= Dr. YLR, J Crl.P.No.6684 of 2025 Dated 14.07.2025 06.06.2025. lt is the contentiorl of the learned counsel for the petitioner that the petitioner was again arrested on 09.06.2025 in the instant case. The learned Assistant Public Prosecutor also submits that the main Accused No.1 was already enlarged on bail by the learned Single Judge of this court in crI.P.No.3608 of 2025 vide order dated 10.07.2025. It is admitted that the preliminary charge sheet was fI'Ied. 7. In view of the above facts and circumstances of the case, considering the alleged role played by the petitioner, the nature of the allegations, and the entire gamut'of the case', this Court deems it fit {o release the petitioner on bail with some stringent conditions. 8. This Court is of the opinion that if certain stringent conditions are imposed on the petitioner for securing his presence before the learned Trial Court for trial, the interest of justice would be met. _9. ln the ,result, the Criminal Petition is allowed with the following conditions: i. The petitioner/Accused No.3 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only), with ilo sureties for the like sum each to the satisfaction of the learned czfs? 1 5 Dr. YLR, J Crl.P.No.6684of 2025 Dated 14.07.2025 Vll Additional Judicial First Class Magistrate at Visakhapatnam. ii. Th-e petitioner/Accused N-o.3 shall appear before the Investigation Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, until further orders. iii. The petitioner/Accused No.3 shall not leave the limits of the District without prior permission from the learned Trial Judge. iv. The petitioner/Accused No.3 shall not commit or indulge in similar offences in future. v.
