GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a issue appropriate Writ, order or direction more particularly one in the nature of MANDAMUS declaring that the action of the Respondents 3 and 4 in not investigating the complaint filed by the Petitioner in the F.I.R.No.66/2019, registered by the 4th respondent under Sections-193, 196, 199, 467, 468, 471, 474, r/w 149 I.P.C. and Section-156(3) of Cr.P.C. against the accused therein inspite of specific order dated 08/01/2019 passed by the learned Judicial Magistrate of First Class, Jaggayyapeta, in C.F. No.5506 of 2018 and further issuance of the present impugned notice Notice to the Complainants dated 31/10/2020 by the 4th respondent, served on the Petitioner on 2 31/10/2020 as illegal, arbitrary, unjust and violative of Articles- 14, 19, 21 of the Constitution of India and contrary to the provisions of Criminal Procedure Code and consequently direct the Respondents to investigate and file charge-sheet including arresting the Accused in F.I.R. No.66 of 2019 registered by 4th respondent in accordance with the law in the interest of Justice” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that the complaint filed by the petitioner has been forwarded to the concerned police under Section 156(3) of Cr.P.C. and investigating officer upon investigating the case referred the case as Civil in Nature. 3.
