Petitioner – Ravi Kumar alias Mani has filed petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of SUNIL DEVI 2025.08.01 11:14 I attest to the accuracy and integrity of this document CRM-M-7491-2025 (O&M) -2- regular bail in FIR No.125 dated 12.12.2024, under Sections 64, 126(2), 351(1), 351(3) of BNS 2023, registered at Police Station Balachaur, District SBS Nagar (Annexure P-1). 2. As per facts of case, prosecutrix ‘S.K.’ gave her statement that she was working as a private teacher in Little Star Model School, Village Nanowal Bet. She was married to Rajesh Kumar on 05.05.2013. She is having a daughter and a son. Her husband went to Australia twice due to his work. Ravi Kumar alias Mani living in her neighbourhood is also a married man. He started harassing her and forcibly asked her to stay with him. He used to enter her house by scaling the wall during odd hours. She tried to make him understand and disclosed about it to his wife. For the last about two years, taking undue advantage, he developed forcible physical relations with her. He stopped her on the way to school and threatened to kill her and at times threatened to commit suicide. He interfered in her married life. With these allegations, present FIR has been registered. 3. Learned counsel for petitioner argued that petitioner is behind the bars since 14.12.2024. Allegations levelled against him are false and due to some misunderstanding. Statement of prosecutrix has been recorded as PW-1 (Annexure P-5) where she has not levelled any allegation against the petitioner. Trial in this case may take long time. He is ready to abide by the terms of bail order. It is prayed that his regular bail petition may be allowed. 4. Bail petition is opposed by learned counsel representing State. It is confirmed that petitioner was arrested in this case on 12.12.2024. At the time of filing of status report, the case was fixed for framing of chargesheet. Considering the specific attribution, petitioner is not entitled to be released on regular bail. 5. I have considered the aforesaid factual position. As referred above, on completion of investigation, challan is already presented and the statement of prosecutrix is also recorded where she has not levelled any allegation against the petitioner. The trial is at initial stage. Conclusion of prosecution evidence may take long time. Therefore, without expressing my mind on merits of the case, regular bail petition filed by petitioner – Ravi Kumar alias Mani is allowed. He is ordered to be released on bail on furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Judge concerned. 6.
