This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

“.... a Writ of Mandamus declaring the action of the Respondent Nos.4 and 5 in repeatedly calling the petitioner to their police station and high-handedly obtaining three signed unfilled cheques bearing Cheque No. 783901 and 783902 and 783903 of Punjab National bank, Mangalagiri Branch and Four signed unfilled Promissory notes and a signed unfilled Rs.100/-Non- Judicial Stamp by coercing the petitioner as illegal, arbitrary unconstitutional, violative of Article 14, 19 and 21 of the Constitution of India, Consequentially direct Respondent Nos.2 and 3 herein to take action against Respondent Nos.4 and 5 and also not to summon the petitioner.”

When the matter is taken up for hearing, Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, basing on the report submitted by Respondent No.4 against the Petitioner, the Petitioner was called to the Police Station for preliminary enquiry, but they have not obtained any signed unfilled pronotes or cheques as alleged. Learned Assistant Government Pleader would further submit that the Petitioner appeared before the Police and submitted that they will settle the issue in the presence of the elders and a document viz., ‘Oppandapatramu’ is also placed on record to that effect.
Learned Assistant Government Pleader further submits that, thereafter the Police never called the Petitioner to the Police Station nor obtained any unfilled signed cheques bearing Nos.783901, 783902 and 783903 of Punjab National Bank, Mangalagiri Branch and four unfilled signed promissory notes and a signed unfilled Rs.100/- Non-Judicial Stamp from the Petitioner. 3
3. Sri Kurapati Satyanarayana Raju, learned counsel for the Petitioner would submit that, recording the same, the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
