Somashekar, C.J.) 11.08.2025 [1] The present miscellaneous application in MC(WA) No. 207 of 2022 has been filed by the applicant under Order 1 Rule 3 read with Rule 8A of CPC, 1908 seeking for impleadment of the applicant as respondent No. 8 in WA No. 55 of 2021. [2] Heard the learned counsel Mr. A. Mohendro for the applicant/petitioner and also Mr. N. Khelemba, learned counsel for the respondents/appellant in WA No. 55 of 2021. [3] Perused the provision of Order 1 Rule 3 read with Rule 8A of CPC and whereby seeking for impleadment of the applicant as respondent No. 8 in WA No. 54 of 2021. Wherein in the said proceeding, the deponent namely, Joel G. Haokip who had specifically stated in this affidavit that he is the applicant in the present miscellaneous case which has been initiated under Order 1 Rule 3 read with Rule 8A of CPC, 1908. Whereas, in para 2 of the affidavit, it is stated that the applicant has gone through a copy of the Misc. Application and therefore, he is now well acquainted with the facts and circumstances of the case and further stated that the contents of the aforesaid para Nos. 1 to 14 in respect of the Miscellaneous application proceeding are found to be true and correct. However, in this affidavit, the applicant is seeking for intervention of the reasons stated therein. [5] However, keeping in view the contents made in the miscellaneous proceeding are concerned, it is deemed appropriate that without expressing any opinion on the merits of the case, this miscellaneous application is considered in the interest of justice. [6] The applicant be directed to carry out the amendment in the rank of the respondent No. 8 as sought for in WA No. 55 of 2021 and also be directed to carry out the amendment in the cause title of the aforesaid appeal. The counsel for the applicant/petitioner be directed to submit the amended cause title of the appeal memo in the said writ appeal and copy of the same be furnished to the learned counsel for the respondents for the purpose of reference.
