The case of the -prosecution is that on 29.08.2024 at 09.45 hours, Sub- Inspector of Police, ChintapaIIi Police Station, on receipt of credible information, he along with his staff, proceeded to APR College, Chin{apalli Village and Mandal and found Accused NoS.1 and 2 in possession of 10.112 Kgs of Ganja worth of Rs.50,000/-. The accused persons were arrested and the contraband along with TATA India Car Bearing No.AP 39 DE 8930 were seized under the cover of mediators report. The petitioner/Accused No.3 was apprehended on 18.05.2025 and remanded to judicial custody. 3. Ms. Bandi Praveena, the learned counsel for the-petitioner, submits that the petitioner has not committed any offence; he was falsely l'mplicated in this case; he is sole breadwinner of his family; he is' ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 4. Per confra, Ms. P. Akhila Naidu, the learned Assistant Public Prosecutor, submits that the petitioner herein is the one who supplied Ganja to the Accused Nos.1 and _2 by cultivating. If the petitioner is enlarged on bail, he would commit more offences of similar nature; and urged to dismiss the bail petition. "_,------`' 5. The petitioner has been in judicial custody for the past 59 days. charge sheet has not yet been filed by the Investigating officer in th[|s case. The allegation is that the petI-tiOner iS I'ndulged in cultivation of Ganja. The accused Nos.1 and 2 were found in possession of 10.112 KGs of Ganja which is not a commercial quantity. There are no adverse antecedents reported against the petit]|oner. 7. Taking into consideration of the nature of aIIegatl'ons levelled against the petitioner, his alleged role in this case and the period of detention undergone by him, this court is inclined to enlarge th`e petitioner on bail. 8. Thl-s Court is of the opinion that if certal-n stringent conditI'OnS are imposed on the petitioner for securing his presence before the learned Trial Court for trial, the interest ofjus{ice would be met. 9. ln the result, the Criminal Petition is allowed with the following conditions: I|.
