05/ 24.09.2025: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Hunterganj P.S. Case No. 04/2018, corresponding to G.R. Case No. 56/2018, registered under sections 353, 420, 183, 279, 336, 201, 120B, 224 and 225 of I.P.C, pending in the Court of learned Judicial Magistrate, Ist Class, Chatra.

Learned counsel for the petitioners submits that petitioners are owner of Hywa and hywa has not been seized rather trucks have been seized and allegations are made that sand was loaded on the said truck. He further submits that petitioners have no criminal antecedent which is disclosed in para 13 of the petition. He further submits that co-accused persons have been granted anticipatory bail in A.B.A. No. 1950/2024, 1429/2025, A.B.A. No. 505/2025 and A.B.A. No. 449/2024. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of illegally loading the sand on the truck.

Considering that petitioners are owner of Hywa, they have no criminal antecedent which is disclosed in para 13 of the petition and co- accused persons have been granted anticipatory bail in the aforesaid A.B.As, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Chatra, in connection with Hunterganj P.S. Case No. 04/2018, corresponding to G.R. Case No. 56/2018, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
