Heard Mr.Ajit Kumar Sinha, learned Senior Advocate appearing through video conferencing assisted by Mr.Apurv Goyal, learned counsel for the petitioner as well as Mr.Shashank Thakur, learned Deputy Advocate General appearing for respondent No.1/State and Mr.Amrito Das, learned counsel through video conferencing appearing for respondent No.2. 2. The present writ petition has been filed by the petitioner with the following prayers: “a. Issue a writ of certiorari, setting aside the Impugned Letter dated 28.03.2025; b. Issue a writ of mandamus or any other appropriate writ, order, directions in the nature thereof directing the Respondent No. 2 to withdraw the Impugned Letter dated 28.03.2025: c. Issue a writ for mandamus or any other appropriate writ, order, directions in the nature thereof, directing the Respondent No. 2 to comply with the Order dated 07.02.2025 passed by this Hon'ble Court in Writ Petition bearing number W.P. (C) No. 3983 of 2023 thereby directing the Respondent No. 2: d. And consequently, issue a writ of mandamus or any other appropriate writ, order, directions in the nature thereof, directing the Respondents to release the amounts withheld against RA Bill No. 23. i.e., Rs. 8,39,24,141/- (Rupees Eight Crore Thirty-Nine Lakh Twenty-Four Thousand One Hundred Forty-One Only); e. Pass any other Order in favour of the Petitioner that this Hon'ble Court may deem fit in the interest of justice; and f. The instant Writ Petition be allowed with costs.” 3 3. On a pointed query being made from learned Senior Advocate with regard to prayer clause “c” that the petitioner shall file contempt to comply with the order dated 7.2.2025 passed by this Court in WPC No.3983/2023, he could not give satisfactory reply with regard to said prayer and so far as other prayers are concerned, he seeks permission of this Court to withdraw this petition with liberty to file a fresh petition with appropriate prayers and as such, wasted the precious time of the Court . 4. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty, as prayer for, subject to depositing a sum of Rs.25,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government Special School for Intellectually Retarded Girls, Gaganpur, Ambikapur, District Sarguja (CG). However, it is made clear that the cost which is being imposed shall not stand in any impediment for hearing on merits of the case. 5. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioner after retaining the photocopies of the same.
