THE ADVOCATE GENERAL ORDER: (per Hon’ble Sri Justice R Raghunandan Rao) The present writ petition is on the question of custody of the son of the petitioner and the 4th respondent. The child is presently in the custody of the 4th respondent. 2. The petitioner has moved G.W.O.P No.16 of 2024 before the IX Addl. District Judge at Kovur and the same is presently pending. 2 3. The petitioner has moved the present petition on the ground that the child is not being allowed to interact with her and she has not seen the child for quite some time. 4. This Court had referred both the parties to mediation to see that the issue could be resolved amicably. As mediation has failed, the parties are again before us. 5. In view of the fact that the petitioner has already approached IX Addl. District Judge by way of G.W.O.P No.16 of 2024, it would not be appropriate for this Court to take up the matter. 6. Accordingly, the writ petition is closed, leaving it open to the petitioner to pursue her remedies by way of G.W.O.P No.16 of 2024. 7. However, as an interim measure, pending disposal of G.W.O.P No.16 of 2024, the following interim arrangement is being made:- i. The child shall be handed over to the petitioner on Friday evening at the residence of the 4th respondent and shall be handed over to the 4th respondent on Sunday evening every alternate weekend. ii. It would also be open to the petitioner to visit the child at the residence of the 4th respondent and interact with the child on the Sunday of the weekend when she does not have custody of the child. 3 iii. It would also be open for her to take the child out, but within the confines of Tadepalligudem Municipality. iv. This arrangement shall not be applicable when the child is appearing for any examination. There shall be no order as to costs.
