3. A perusal of the material on record will indicate that on 09.10.2023, the respondent No.2 filed the impugned complaint which was registered as an FIR in Crime No.321/2023 against the petitioner for the offences punishable under Sections 498A, 323, 354, 417 read with Section 34 of the Indian Penal Code, 1860 (for short, 'IPC'). HC-KAR NC: 2025:KHC:22183 CRL.P No. 8336 of 2024
4. A perusal of the material on record will indicate that in so far as the allegation relating to the offence punishable under Section 498A of IPC is concerned, it is an undisputed fact that the petitioner is neither the husband of the respondent No.2 nor is he related to the husband of respondent No.2 and consequently, it cannot be said that the petitioner is guilty of the offence punishable under Section 498A of IPC as held by the Hon’ble High Court of Kerala in the case of Dr. Aswin V. Nair v. State of Kerala Represented by Public Prosecutor and Others [2024 SCC OnLine Ker 3747].
5. It is also relevant to state that in so far as the offences punishable under Sections 323, 354 and 417 of IPC are concerned, the necessary ingredients in this regard are not forthcoming and are conspicuously absent in the complaint, FIR, charge sheet materials, statements of witnesses, documents etc. and as such, it cannot be said that the petitioner is guilty of the aforesaid offences also. Under these circumstances, I am of the considered opinion that the petitioner cannot be said to be guilty of the alleged offences and consequently, the impugned proceedings deserve to be quashed.
