GP FOR FINANCE PLANNING The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No. 16612 OF 2024 ORDER: The Writ Petition is filed questioning inaction of the respondents in withholding the amounts of Rs.5,46,099/- and Rs.17,66,147/- even after finalizing the bills payable to the Petitioner in relation to works i.e., “1. Construction of CC road SSV Vaibhav Apartment road and Yekalavya Nagar cross at 21073135 sachivalayam area in 45th division under GGMP Funds Rc.E6-1015167/2023” vide Agreement No.54 EEIGGMP/2023-24, dated 12.06.2023 and 2. Raising of existing four roads in front of the Masjid in 43 division Rc.E6-117922/2022”, vide Agreement No.72 EE-I/GGMP/2022-23 dated 01.02.2023”. 2. When the matter is taken up for hearing, the learned Standing Counsel passed on written instructions received by him, signed by the Commissioner, Vijayawada Municipal Corporation, wherein it was mentioned at paragraph No.4 that the Petitioner had executed the work as stipulated under agreement referred above and that the payment could not be made due to lack of funds. It was further mentioned that the Municipal Corporation will be paying the amounts as and when the amounts are released, without any delay. 3. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition with the following direction: 3 (i) The Respondents are directed to pay the amounts due to the Petitioner within a period of four (04) months from the date of receipt of the copy of this order.
