Order 18/09/2025
1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.76/2025 registered at Police Station Bhankrota, District Jaipur (West) for the offence(s) under Sections 103(1) and 191(2) of BNS.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the eye witnesses namely- Sunil, Anil, Ramnarayan, Vijay Singh, Kesarlal and Puranmal, in their statement rendered under Section 180 of BNSS have not named the petitioners for causing assault on deceased Govardhan. It is also contended that no identification parade was conducted by the Investigating Officer verifying the statements of the aforesaid witnesses. In the charge-sheet, it is stated that Monika and Prabhu Narayan were standing outside the fence and co-accused Dinesh, Suresh, Vikas and petitioner Kajod, Suwalal & Ramlal entered into the field and thereafter Dinesh inflicted the injury on the head of the deceased Govardhan and other co-accused also assaulted the deceased, however, there is not substantive evidence available on record, corroborating the conclusion drawn by the Investigating Officer. It is also contended that two vehicles were recovered despite that it cannot be said that the petitioners were involved in assaulting the accused until and unless there is corroboration from the eye witnesses. The other co-accused Monika who has also been charge-sheeted has already been
[2025:RJ-JP:38295] (3 of 3) [CRLMB-8375/2025] enlarged on bail by the Co-ordinate Bench of this Court vide order dated 04.07.2025. The petitioners are in custody since 04.03.2025 and trial of the case may take considerable time, therefore, considering the above facts, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed these bail applications. 4. Heard and perused the material available on record. 5. Considering the fact that the aforesaid eye witnesses have not named the petitioners in the assault which resulted into the death of the Govardhan, charge-sheet shows that no identification parade was conducted from the material eye witnesses, therefore, considering the above facts, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely:
1. Prabhu Narayan S/o Shri Hanuman Sahay, 2. Ramlal S/o Shri Hanuman, 3. Suwalal S/o Shri Hanuman and 4.
Kajod S/o Shri Dhannalal, in connection with FIR No.76/2025 registered at Police Station Bhankrota, District Jaipur (West), shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
