THE HON’BLE SRI JUSTICE BATTU DEVANAND AND THE HONOURABLE SRI JUSTICE A. HARI HARANADHA SARMA WRIT APPEAL No.760 of 2025 JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand)
This Writ Appeal is filed questioning the inaction of the learned Single Judge, in considering the Stay Petition filed against the impugned proceedings, dated 13.05.2025, in the Writ Petition No.14355 of 2025. 2. Heard the learned counsel for the appellant and the learned standing counsel for the respondents. 3. The appellant is the petitioner in the Writ Petition. Against the proceedings issued by the respondent No.3, dated 13.05.2025, the said Writ Petition is filed. Along with the Writ Petition, the petitioner sought to stay the transfer order, dated 13.05.2025, issued by the respondent No.3 transferring the petitioner from Ongole to Addanki. Admittedly, the petitioner is working as Administrative Officer at Ongole since 05.07.2021. Expressing her inability to work in the office of Addanki, being a woman with disability, she sought to retain her at Ongole. But the said request is not considered by the respondents. The reason stated by the petitioner is that in the office of Addanki, there is no lift or ramp facility enabling her to attend office to discharge her duties. As she could not climb stairs at first floor, at the office of Addanki, she requested to retain her at Ongole. 4. During the pendency of the Writ Appeal, learned counsel appearing for the respondent-L.I.C., submits that they are ready to accommodate the petitioner at the office of Kandukuru, where the office is situated in the ground floor. For that also, the petitioner is not willing. 5. Under these circumstances, in our considered view, it is appropriate and reasonable to dispose of the Writ Petition permitting both the counsels to raise their contentions before the learned Single Judge in the Writ Petition to meet the interest of justice. 6. Accordingly, the Writ Appeal is disposed of, enabling the learned counsels to make their contentions before the learned Single Judge during the hearing of the Writ Petition, as the Writ Petition is still pending. Further, the learned Single Judge is requested to dispose of the Writ Petition, at the earliest after hearing both sides. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
