JUSTICE MARLI VANKUNG ORDER 20.01.2025 Heard Mr. B.K. Mahajan, learned counsel for the applicant along with Ms. Vanneihsiami, learned Addl. Public Prosecutor for the State respondent. The instant bail application is for the release of the applicant, who was arrested on 11.06.2024 in connection with C & EO Police Station Case No. 5/2024 u/s 408, 419, 466, 471, 472, 477(A), 120(B) & 34 of the IPC. Page No.# 2/2 The submission of the learned counsel for the applicant on 16.01.2025 was that the applicant is entitled to default bail, since he has been in custody for more than 90 days from his arrest on 11.06.2024. Thereafter, the learned Addl. Public Prosecutor was instructed to get the latest instructions and verify whether the applicant was entitled to default bail. The matter is again listed today. The learned Addl. Public Prosecutor today has produced a copy of the order passed by the Chief Judicial Magistrate, Aizawl in Bail Appln. No. 1120/2024 wherein, she submitted that the applicant was already granted bail vide the Order of the learned Trial Court dated 29.10.2024. Copy of the said order is to be marked ‘X’ and placed in the file. On perusal of the said order, it is seen that the applicant was granted bail by the learned Chief Judicial Magistrate vide its order dated 29.10.2024 in Bail Application No. 1120/2024 arising out of C & EO Police Station Case No. 5/2024 dated 10.06.2024 u/s 408, 419, 466, 471, 472, 477(A), 120(B) & 34 of the IPC. In view of the above, it appears that the instant Bail Application No. 84/2024 is infructuous and accordingly stands disposed of. JUDGE Comparing Assistant
