GP FOR FINANCE PLANNING The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No. 16611 OF 2024 ORDER: The Writ Petition is filed questioning inaction of the respondents in withholding an amount of Rs.13,50,946.030/- even after finalizing the bills payable to the Petitioner in relation to work i.e., “providing BT Roads with hot mix process in kedeswara peta 34th division for Dust free roads (15th FCG-Air Quality-2020-21-2nd Instalment) Rc.E6-11623/2022”, vide Agreement No.47/2022-23, dated 08.09.2022”. 2. When the matter is taken up for hearing, the learned Standing Counsel passed on written instructions received by him, signed by the Commissioner, Vijayawada Municipal Corporation, wherein it was mentioned at paragraph No.1 that the Petitioner had executed the work as stipulated under agreement referred above and that the payment could not be made due to lack of funds. It was further mentioned that the Municipal Corporation will be paying the amounts as and when the amounts are released, without any delay. 3. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition with the following direction: (i) The Respondents are directed to pay the amounts due to the Petitioner within a period of four (04) months from the date of receipt of the copy of this order. 3 There shall be no order as to costs.
