ORDER 20.01.2025 Mr. Lalchhanhima Sailo, learned counsel for the petitioner and Mr. C Zoramchhana, learned Standing Counsel, NIT, Mizoram for all the respondents. Having regard to the nature of controversy projected by the petitioner, the writ petition is taken up for disposal at the motion state itself. [2.] By filing this writ petition, the petitioner has challenged the Order dated 24.07.2024 by which the effective date of her movement to higher Grade Level- 13 and re-designation as Joint Registrar (Personal to the incumbent) initially made to be effective from 06.09.2016 as per the relevant Recruitment Rules was changed and made effective only from 14.06.2024 i.e. from the date of the decision taken by the Board of Governors, NIT, Mizoram in its 40th Meeting dated 14.06.2024. Being highly aggrieved with the same, the petitioner submitted her representation to the Registrar, NIT, Mizoram on 02.02.2024 (Annexure-19 A). Despite receipt of the same by the authority concerned since her grievance was not considered and her representations not disposed of, she has filed the instant writ petition. [3.] The learned counsel for the petitioner submits that the petitioner is at the
Page No.# 3/4 advanced stage of her service career and that she is due to retire sometime in the middle of this year 2025. He, therefore, submits that there is urgency for mitigation of the grievance of the petitioner. [4.] When the matter was listed on 14.01.2025, Mr. C Zoramchhana, learned Standing Counsel, NIT, Mizoram was asked to obtain instructions as regards the status of the two representations submitted by the petitioner. Today, he submits that the instructions he received is that the representations have not been
disposed of till date. He also submits that the Board of Governors is within its power to fix the effective date for fixing the date of movement to higher Grade of Level-13 to the petitioner. [5.] Having regard to the fact that the two representations submitted by the petitioner before the respondent authorities have not been considered and are still pending, this Court without entering into the merits of the case at this stage is inclined to dispose of the matter with a direction to the respondent authorities, more particular to respondent No. 1 to place the representations submitted by the petitioner on 02.02.2024 and 08.08.2024 before the Board of Governors (respondent No. 3) within a period of 30 days from the date of receipt of a certified copy of this order. The Board of Governors on receipt of the same shall, within a period of 90 days, consider the same in accordance with
Page No.# 4/4 law and dispose of the representations by way of a Speaking Order. A copy of the order to be passed should be communicated to the petitioner. It is needless to observe herein that if the petitioner is still aggrieved on the order be passed, she will be at liberty to approach this Court again.
