No. 15/2025 on the file of the court of The XVI Additional District Judge, Nandigama, pending disposal of the above CRP and to pass Counsel for the Petitioner: 1.VS K RAMA RAO Counsel for the Respondent{S): 1. 3 (RNT,J C.R.P,No.l544 of 2025) The Court made the following: ORDER: This Civil Revision Petition is filed under Article 227 of the Constitution of India by the petitioner/plaintiff, being aggrieved by the docket order dated 09.05.2025 passed in I.A.No.399 of 2025 in O.S.No.15 of 2025 on the file of the XVI Additional District Judge, Nandigama, Krishna District. The plaintiff filed O.S.No.15 of 2025 seeking specific performance of the agreement of sale dated 27.12.2024. In the said suit, on 16.04.2025, an ad-interim injunction was granted in favour of the petitioner, restraining the respondents/defendants from alienating item Nos.1 and 2 of the petition schedule properties to third parties until the next date. 2. On the next date, i.e., 29.04.2025, the defendants appeared through counsel. Defendant No.1 filed a counter, and the interim injunction was extended till 02.05.2025. On 02.05.2025, the interim injunction further extended, and the matter was posted to 09.05.2025. On that date. Defendant No.1 had already filed a counter and submitted that there was urgency in the matter, whereas Defendant No.2 sought time to file a counter. The petitioner/plaintiff also filed an adjournment petition. 3. was In these circumstances, the learned trial Court, while extending the interim order till 16.06.2025, made certain observations stating that the 4. 4 (RNT,J ^ C.R.P.No.1544 of 2025) petitioner’s counsel’s application was premature, vexatious, and irrelevant, and imposed costs of Rs.5,000/- to be paid to MLSA, Nandigama. 5. Learned Senior Advocate appearing for the petitioner submits that that there is no grievance with respect to the imposition of costs, which have already been deposited. The only grievance is regarding the observations made by the learned trial Court characterizing the petitioner’s application as vexatious and irrelevant. Be that as it may, since the costs have already been deposited, it is observed that the remarks made by the trial Court characterizing the application as vexatious, irrelevant, or premature shall not be construed as findings against the petitioner/plaintiff or his counsel. 6. 7. With the above observation, the Civil Revision Petition is disposed of. No order as to costs.
