Ms. Menka Raj Chauhan, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents. 2. By way of instant petition, the petitioner has prayed for following substantive relief:- “a. Writ in nature of mandamus may be issued directing the respondent department to allow the petitioner to exercise his option for fixing his pay consequent upon his promotion to the post of Superintendent Grade-II on notional basis with effect from 05.10.2015 with all consequential benefits in view of judgment passed in CWPOA No. 5312/2020 1 Whether reporters of the local papers may be allowed to see the judgment? 2 titled as Devini Sharma and Ors. vs. State of H.P. and pay fixation be made accordingly.” 3. Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the Judgment passed by a coordinate Bench of this Court in CWPOA No. 5312 of 2020, titled as Devini Sharma & Ors. vs. State of H.P. & Anr, on 17th May, 2024 (Annexure P-3). He further submits that petitioner shall be satisfied in case the respondents are directed to decide the representation, Annexure P-4, submitted by the petitioner in a time bound manner in light of judgment ibid. 4. Accordingly, the petition is disposed of without making any comments on the merits of the case of the petitioner. It is directed that respondents shall consider and decide representation, Annexure P-4, submitted by the petitioner, in light of judgment passed by a coordinate Bench of this Court in CWPOA No. 5312 of 2020, titled as Devini Sharma & Ors. vs. State of H.P. & Anr, on 17th May, 2024 (Annexure P-3) within eight weeks from today by passing a speaking order. In case, the petitioner is found similarly situated as petitioners in CWPOA No. 5312 of 2020, titled as Devini Sharma & Ors. vs. State of H.P. & 3 Anr, on 17th May, 2024 (Annexure P-3), he shall also be granted the same benefits as granted to petitioners in above referred case. 5.
