N. Maurya Hon'ble Prakash Padia,J. 1. The only prayer made by learned counsel for the petitioner in the present petition is to direct the respondent No.2/ Member Secretary, U.P. Pollution Control Board Lucknow to decide the application dated 21.02.2025 for compassionate appointment under dying in harness rules. 2. Facts in brief as contained in the writ petition are that the father of the petitioner namely Vijay Kumar Dubey died while working on the post of Regional Officer, U.P. Pollution Control Board on 05.10.2023 and after the death of his father, the petitioner submitted application for appointment on compassionate ground under dying in harness rules. It is argued by learned counsel for the petitioner that one Smt. Santosh Dubey, alleging herself to be the wife of Late Vijay Kumar Dubey filed Writ A No.20729 of 2024 in which the petitioner has already filed impleadment application. 3. It is argued by learned counsel for the petitioner that considerable time has already been passed but till date no final decision has been taken in the matter. 4. Sri J.M. Maurya, learned counsel for the respondent that respondent No.2 will take a decision in the matter expeditiously. 5. Heard learned counsel for the parties and perused the record. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/ Member Secretary, U.P. Pollution Control Board Lucknow to take a decision in the matter most expeditiously and preferably within a period of three months strictly in accordance with law from the date of production of certified copy of this order but after providing opportunity of hearing to Smt.
