Jha, Advocate --- 05/31.01.2025 Heard the parties. The appellant has filed this criminal appeal against order dated 07.06.2024 passed in A.B.P. No.191 of 2024 passed by Mr. Dheeraj Kumar, learned Special Judge (SC/ST Act), Sahibganj, whereby and wherein, learned Special Judge (SC/ST Act), Sahibganj rejected the anticipatory bail application of the appellant. The appellant is apprehending his arrest in connection with Taljhari P.S. Case No.13 of 2021, for the offences under Sections 147/ 148/ 149/ 323/ 341/379/506 of the I.P.C. and Section 3(X) of the SC/ST Act, pending in the court of learned Additional Sessions Judge-cum- Special Judge SC/ST Act), Sahibganj. It was submitted that occurrence has taken place due to land dispute. It was further submitted that the allegation that the appellant had abused the informant by his caste name, has been made just to make this case graver. Mr. Santosh Kumar Jha, learned counsel appearing on behalf of the respondent No.2 has vehemently opposed the prayer for bail and on specific query, whether the respondent No.2 has sustained any injury, he conceded that no injury was caused to respondent No.2. It appears that this case has been instituted due to land dispute between the parties. -2- Considering the aforesaid facts, appellant, named above, is directed to surrender before the learned court below within two weeks from the date of receipt of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-cum- Special Judge (SC/ST Act), Sahibganj, in connection with Taljhari P.S. Case No.13 of 2021, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023. (Ambuj Nath, J.) Jay/-
