It appears that the petitioner has earlier moved in A.B.A. No.5891 of 2024 and the same was withdrawn and now subsequently present ABA application has been filed. It appears that no new ground is taken in the present ABA application and without moving before the learned Sessions Judge this petitioner has filed this ABA directly in the High Court. 2. In view of above, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to move before the learned Sessions Judge on the new ground. 3.
