(BY SRI. V. SHIVA REDDY, AGA FOR R1 TO R6 AND R10)
THIS W.P. IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE ENDORSEMENT DATED 05.03.2025 ISSUED BY THE 10TH RESPONDENT VIDE ANNEXURE-S, DIRECT THE 10TH RESPONDENT TO CONSIDER THE STATEMENT OF OBJECTION FILED BY THE PETITIONER VIDE ANNEXURE-T AND U DATED 24.02.2025 AND 28.03.2025 RESPECTIVELY AND ETC.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA
ORAL ORDER
1. The petitioner is aggrieved by an endorsement given by the ADLR by which he has taken note of the fact that the petitioner has filed objections to the proposed survey and has called upon the petitioner to produce any documents in support of his objection within a week, failing which steps would be taken in accordance with law.
2. If the petitioner has any objection to the survey (as evidenced by a copy of Annexure-T), it is obvious
- 4 -
NC: 2025:KHC:15069 WP No. 10277 of 2025
that ADLR will take note of said objections before he decides to conduct the survey. There is, therefore, no justification for entertaining the writ petition against an endorsement by which the petitioner has been called upon to produce the documents.
3. However, learned counsel for the petitioner seeks to contend that an attempt was being made to erect the boundary stone, despite the fact that the Deputy Commissioner has set aside the order of mutation passed in favour of the contesting private respondents and this is causing him grave prejudice.
4. A perusal of the objections filed by the petitioner would indicate that the petitioner is already before the Civil Court in O.S.No.296/2023 against the private respondents seeking a decree of injunction. It is needless to state that if there is any interference with the possession of the petitioner, it would be open for him to seek appropriate interim order in the aforementioned suit.
