Malhotra, learned counsel for the applicant, who submits that by filing this application, the applicant seeks condonation of 284 days delay in filing the connected appeal against the Order dated 30.10.2023 passed by the Court of Civil Judge (Senior Division) - II, Aizawl. The learned counsel submits that since notice was not issued to the applicant or newspaper publication not done prior to issuance of the Heirship Certificate, the applicant was unaware Page No.# 2/2 about the issuance of the said Certificate. Upon coming to learn about the same belatedly, the applicant immediately filed the connected appeal and that in the meantime, the delay of 284 days has occasioned. The learned counsel submits that there is no malafide intention on the part of the applicant in not preferring the appeal on time and it was solely due to reasons beyond his control. He therefore submits that the delay may be condoned. Mr. B. Lalramenga, learned counsel for the sole respondent submits that he has no objection if the delay is condoned. Considering the above submissions and on perusal of the materials available on record, this Court is inclined to condone the delay and accordingly, the delay of 284 days in filing the connected appeal stands condoned.
