03/ 20.08.2025 Heard learned counsel for the petitioners and learned A.P.P. appearing for the State.

The petitioners are apprehending their arrest in connection with Complaint Case No. 172 of 2021, registered for the offences under Section 33 of the Indian Forest Act, pending in the court of learned Sub-Divisional Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioners submits that it has been alleged that the petitioners are involved in preparation of the land for cultivation of poppy plants. He submits that the similarly situated other co-accused has already been provided the privilege of anticipatory bail in A.B.A. No. 2039 of 2025 by the co-ordinate bench.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there against the petitioners of preparing the land to cultivate the poppy plants.

Considering that the similarly situated other co-accused has

already been provided the privilege of anticipatory bail in A.B.A. No. 2039 of 2025 by the co-ordinate bench and the only allegation against the petitioners are that they are involved in preparing the land for cultivation of poppy plants, I am inclined to provide privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra, in connection with Complaint Case No. 172 of 2021, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
