Mr. Gautam Sood, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondent. 3. The petitioner is accused in case registered vide FIR No.107 of 2021 dated 01.04.2021, registered at Police Station, Sadar, Una, under Sections 302, 120-B IPC and 25 of Arms Act. He is in custody in aforesaid case since 01.04.2021. 4. It is averred that the petitioner earlier also applied for temporary bail to appear in Common University Entrance Test w.e.f. 13.03.2025 to 31.03.2025. His application was allowed by learned Additional Sessions Judge (I), Una vide order dated
07.03.2025. The petitioner, after appearance in the aforesaid test,
2 had surrendered to custody as per order dated 11.08.2025 passed by learned Additional Sessions Judge(I), Una. 5. The petitioner is stated to have qualified the examination and has been selected for counselling to Punjab University LLB Course at Regional Centre, Ludhiana. His counselling is scheduled today i.e. 13th August, 2025 between 2:00 PM to 5:00 PM. 6. The petitioner filed an application before learned Additional Sessions Judge (I), Una for interim bail for the purposes of joining the counselling and other admission related procedure, which was registered as bail application No.275 of 2025 in the said Court. Though, the application of the petitioner has been allowed, but he has been allowed to appear for counselling by Virtual Mode. 7. The petitioner has approached this Court now by way of instant petition on the ground that the University Authorities do not allow the counselling through Virtual Mode and the physical presence of the petitioner is required. 8. Noticeably, it is already 11.25 AM and the counselling of the petitioner is scheduled today between 2”00 PM to 5:00 PM at Regional Centre of Punjab University at Ludhiana. The petitioner is lodged in District Jail, Una at Bangarh. Confronted with this, learned counsel for the petitioner has submitted that the
3 mother of the petitioner has already reached the venue and if the petitioner is allowed to travel, it will take him approximately 3 hours to reach Ludhiana from Bangarh. 9.
Keeping in view the rights of petitioner to seek education coupled with the factum of time constraint, this case is being taken on priority. There is hardly any time to be granted to the respondent-State to seek response from the concerned police station. The order passed by learned Additional Sessions Judge (I), Una on 11.08.2025 reveals that the said Court had taken notice of earlier release of petitioner on interim bail and his subsequent surrender before the authorities. It is also revealed from the said order that the prosecution evidence is already over and the case is fixed for recording of statement of accused. 10. Learned Deputy Advocate General has submitted that keeping in view the exigency of the matter, the Court should impose strict conditions so as to avoid any chance of petitioner fleeing from the course of justice. 11. Keeping in view the entirety of facts and circumstances, I am of the view that the interest of justice will be served by allowing the application with the condition that the petitioner shall be taken to the venue of counselling i.e. Regional Centre of Punjab University at Ludhiana today in the custody of jail/police authorities and after completion of formalities will be
4 lodged back in the same jail i.e. District Jail, Una at Bangarh. It is expected from the jail authorities to make all necessary arrangements at the costs of petitioner immediately so as to enable the petitioner to reach the venue of counselling, as noticed above, before closing hours of the day. 12. Registry will immediately communicate this order to the Superintendent of Police, Una as also Superintendent of Police, District Una at Bangarh for compliance. 13.
