Side) ORDER The petitioners apprehend arrest for the alleged offence under Section 306 of the Bharatiya Nyaya Sanhita (BNS) 2023, in Crime No.1029 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.28690 of 2025 2. The allegation against the petitioner is that they are running a Manpower Agency, and under the pretext of providing domestic workers to various households, they allegedly instigated their employees to commit theft of jewels from such houses. It is alleged that, pursuant to this, the accused/A1, who had been engaged through the petitioners' agency to the work at the house of the defacto complainant, committed theft of 7½ sovereigns of gold jewels worth about Rs.5,70,000/-. It is further alleged that after the theft, the accused/A1 informed the petitioners also subsequently intimated to the petitioners and the petitioners, and they, in turn, shared the stolen jewels among themselves. Hence, the present complaint has been registered. 3. The learned counsel for the petitioners submitted that the petitioners are innocent and are bona-fide operators of an employee placement agency. They were not aware of the theft committed by the accused/A1. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court, and are even ready to deposit the value of the stolen articles. Hence, he prayed to grant anticipatory bail to the petitioners. 4. The learned Government Advocate (Criminal side) appearing for the respondent submitted that this is second anticipatory bail application of the 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.28690 of 2025 petitioners. The petitioners, who are running a Manpower Agency, had in fact instigated their employees to commit thefts in houses where they were deployed. In this case, the accused/A1 is the main accused, has been arrested, and out of 7 ½ of sovereigns of gold jewels, 7 sovereigns of gold jewels have been recovered. A copy of statement of the accused/A1 was also produced before this Court, and he also submitted that the investigation is still pending. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioners. 5. Heard both sides and perused the materials available on record, including the statement of the accused/A1. 6. I have gone through the statement recorded from the accused/A1, wherein, the accused/A1 has specifically stated that the petitioners had joined hands with her and committed thefts in various offices and houses, adopting different modes of operation. 7. Considering the nature and gravity of the offence, the role attributed to the petitioners, and the statement of the accused/A1, and also taking note of the ongoing investigation, I am not inclined to grant the extraordinary relief of anticipatory bail to the petitioners.
