Lalzekima, learned counsel for the applicant/appellant along with Mrs. Emily L. Chhangte, learned Legal Aid Counsel for respondent No. 2 and Mrs. Linda L. Fambawl, learned Public Prosecutor for the State respondents. It is seen that the instant application is filed under Section 430 of the BNSS, 2023 for suspension of sentence and stay of the execution of fine and to release the accused petitioner on bail pending disposal of the connected Criminal Appeal No. 11/2025. The learned counsel for the applicant submits that he will not be pursuing the instant IA, since the main Criminal Appeal No. 11/2025 is ready for hearing, and the learned counsels for the respondents also submit that the IA need not be considered when the main Criminal Appeal can be disposed of by the date fixed for hearing. In view of the above submissions, we find it appropriate to dismiss the instant IA.(Crl.) No. 39/2025 on it not being pressed by the learned counsel for the applicant since the main criminal appeal is ready for hearing. Page No.# 3/3 Accordingly, I.A.(Crl.)
