Public Prosecutor for the State appellant. This is an appeal under Section 419 of the Bharatiya Nagarik Suraksha Page No.# 3/3 Sanhita (BNSS), 2023 against the Judgment & Order dated 31.01.2023 passed by the learned Special Judge, POCSO Act, Champhai Judicial District in Sr. No. 8 of 2019, wherein, the accused was acquitted of the charge under Section 376(2) (i) IPC read with Section 4 of the POCSO Act. It is also seen that this Court vide Order dated 10.03.2025 in I.A.(Crl.) No. 50/2024 had granted leave to prefer the appeal to the State appellant. Issue notice to the respondents. Mr. P.C. Lalthangmawia accepts notice on behalf of the sole respondent. Requisite copies of the appeal memo to be duly furnished to the learned counsel for the respondent. TCR is to be called for.
