This is an application wherein petitioner has prayed for a direction for expeditious hearing of the GR Case No. 2884 of 2022 presently pending before learned Additional Chief Judicial Magistrate, Basirhat. It is submitted on behalf of the petitioner, that investigating officer submitted charge-sheet on 30th September, 2022 and since then the matter is pending for charge hearing. It further appears that a date was fixed on 27.03.2023 and thereafter it was adjourned to 2nd January, 2024 which is for more than nine months and thereafter it was adjourned to 05.02.2025 which is after more than 13 months and now the next date has been fixed on 29.04.2026 which is about 15 months later. Accordingly, he submits that a direction may be passed upon the court below for expeditious charge hearing. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite parties will have no cause to prejudice and as such, service of copy of application upon the opposite parties is dispensed with. Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified, the instant
2 application being CRR 5544 of 2025 is hereby disposed of with a direction upon the court below to make charge hearing on the next date i.e., on 29.04.2026 or within a period of thirty days thereafter. This order is passed invoking this Court’s jurisdiction under section 529 of the BNSS read with section 483 of the Cr.P.C. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
