The present application is filed seeking condonation of delay of 82 days in filing the captioned Misc. Civil Application for restoration of F/Misc. Civil Application (for contempt) No.27490 of 2024. 2. Learned advocate Mr.Adeshra has submitted that the contempt petition was filed by the petitioner and vide order dated 21.10.2024, this Court had granted time to remove the office objection(s) of showing the names of the petitioners in the memo of Special Civil Application, order of which is sought for compliance in the aforesaid contempt petition. He has submitted that for want of information, the office objection(s) could not be removed and hence, C/CA/1992/2025 ORDER DATED: 11/06/2025 the matter was dismissed for want of prosecution on 21.10.2024. It is submitted that the petitioners were completely unaware of the fact that the contempt petition was dismissed for non-prosecution and as soon as they came to know about such fact, they filed the captioned Misc. Civil Application for restoration of the contempt petition. He has submitted that the delay is not occurred due to negligence on the part of the applicants and hence, the present application may be allowed. 3. Having regard to the submissions advanced by the learned advocate for the applicants as well as the averments made in the application, in the interest of justice and on a condition of depositing cost of Rs.3,000/-, delay is hereby condoned. 4. The present application stands allowed. Registry to give pakka number to the captioned Misc. Civil Application TODAY itself. Applicants to deposit Rs.3,000/- before the Registry of this Court.
