"8. The Court is mindful of the legislative intent of the POCSO Act which provides that the contact between the accused and the victim should be prevented in order to minimise the trauma experienced by the child. According to us, if the victim is faced with the presence of convict-
[2025:RJ-JP:28583] (5 of 7) [CRLW-853/2025] petitioner, it would have an adverse impact on her mental well-being and he/she would be forced to re-visit the trauma and be reminded of the incident which she would be trying hard to forget. 9. But then, a balance has to be struck between the safety and emotional aspect of the victim and statutory rights of the accused.
We are of the opinion that such balance would be achieved if the accused spends his time of parole at a place which is away from victim's residence. Such order would take care of the apprehension/anxiety expressed by learned AAG. 10. The impugned order dated 10.10.2023 passed by District Parole Advisory Committee, Deedwana-Kuchaman is hereby quashed and set aside and the application for second parole is hereby allowed." blh izdkj bl U;k;ky; dh [k.MihB ds U;kf;d fofu'p; [k.MihB vkijkf/kd fjV ;kfpdk ¼iSjksy½ la[;k 924@2025 'kkg:[k [kku&cuke&jktLFkku jkT; vkfn vkns'k fnukad 22-07-2025 esa jktLFkku canh dkjkodk'k ij fjgk fu;e 2021 ds fu;e 11 o 16 dk fuoZpu fuEu :i ls fd;k x;k gS%& On harmonious construction of Rules 2(g), 5, 6, 10, 11 & 16 the interpretation is that condition of ineligibility for release on parole given in Rule 16 shall not be applicable to an application made under Rule 11 but are for release on Parole under Rule 10. Another aspect is that for circumstances and provisions of IPC mentioned in Rule 16(1) a prisoner is ineligible for release on parole till having served half of the sentence including remission. In case, release of the petitioner covered under Rule 16(1) is to be delayed till serving of half of the sentence it shall defeat the basic purpose of Rule 11 providing for emergent release on humanitarian consideration.
