2. On account of the proceedings having been initiated by the respondent bank by invoking the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the petitioner, who is a lessee in the premises is sought to be dispossessed.
3. Considering the fact that the petitioner does have an alternative remedy of approaching the Debts Recovery Tribunal, and considering the ratio of the judgments of the Apex Court in Radha Krishan Industries v. State of
2 HCJ & RC, J WP 16128 2025 0 Himachal Pradesh [(2021) 6 SCC 771] and United Bank of India v. Satyawati Tondon [(2010) 8 SCC 110], we do not find it a fit case to invoke our extra-ordinary writ jurisdiction under Article 226 of the Constitution of India. The Writ Petition is, accordingly, dismissed. No order as to costs.
