JUSTICE AHANTHEM BIMOL SINGH 27.10.2025 [1] Heard Mr. BR Sharma, learned counsel appearing for the petitioner and Mrs. L. Monomala, learned GA appearing for the respondent. [2] In view of the limited prayer made by the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition is disposed of at the motion stage itself. [3] At the outset, the learned counsel appearing for the petitioner submitted that the petitioner has already submitted an application dated 30.10.1993 requesting the authorities for considering her case for appointment against any suitable post under the Die-in- Harness Scheme on the demise of her father and that the said application is pending for consideration by the authorities. LUCY GURUM AYUM Digitally signed by LUCY GURUMAYUM Date: 2025.10.27 16:32:44 +05'30' Page 2 [4] Subsequently, when no positive action has been taken up by the authorities with regard to the representation submitted by the petitioner, the petitioner submitted another representation dated 21.08.2025 requesting the authorities again to consider her case for appointment against any suitable post under the Die-in-Harness Scheme. [5] The counsel appearing for the petitioner submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by the directing the Director, Health Services, Government of Manipur to consider the representation dated 21.08.2025 submitted by the petitioner on its own merit and strictly in terms of the applicable guidelines and to dispose of the same by issuing an appropriate order within a stipulated period. [6] The learned counsel further submitted that a direction may be issued to the Director, Health Services, Government of Manipur that at the time of consideration of the said representation submitted by the petitioner, the recommendation made by the Chief Medical Officer, Ukhrul District, under its letter dated 10.04.2013 (at Annexure- A/6) should be taken into consideration. [7] Mrs. L. Monomala, learned GA appearing for the respondent fairly submitted that as the prayer made on behalf of the Page 3 petitioner is confined to consideration and disposal of the representation submitted by the petitioner she has no objection in disposing of this writ petition as prayed for by the learned counsel appearing for the petitioner. [8] Taking into consideration the submission advanced by the learned counsel appearing for the parties and on perusal of the record, this Court is of the consider view that it will be in the interest of justice to issue the following directions; (i) The Director, Health Services, Government of Manipur is hereby directed to consider the representation dated 21.08.2025 submitted by the petitioner on its own merit and strictly in terms of the applicable guidelines/rules and to dispose of the same by issuing an appropriate order. (ii) It is made clear that at the time consideration of the said representation submitted by the petitioner, the Director, Health Services, Government of Manipur should also take into consideration the recommendation made by the Chief Medical Officer, Ukhrul District, under its letter dated 10.04.2013 (at Annexure-A/6). Page 4 (iii) It is further made clear that the whole exercise should be completed within three months from the date of receipt of certified copy of this order.
