1. This is the first bail application filed under Section 483 of the Bhartiya Nagrik Shuraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested on 28/09/2024 in connection with Crime No.103/2024, registered at Police Station
2 / 3 Tapkara, Chowki (Kardega), District Jashpur, C.G. for the offence punishable under Sections 103 (1) of B.N.S.
2. The case of the prosecution in brief is that on 26/09/2024 the police received information that dead body of one Bajrang Yadav was lying in Rangadipa forest area, thereafter, the police started investigation and on suspicion the applicant alongwith other co- accused persons were arrested.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case, he has not committed any offence as alleged against him. There is no evidence/material available to connect the applicant in this case, the Police has not seized any weapon from him. Out of three accused person, one co-accused has been granted bail by the Session Court. The applicant is in jail since 28/09/2024 and conclusion of trial may take time, hence, he may be released on bail.

Per contra, learned State Counsel opposes the submission of counsel for the applicant and would submit that present applicant is the main accused in this case as at the time of murder of deceased he has strangulated his neck and, thereafter, with the help of other co-accused persons have transported the dead body of deceased to the Rangadipa forest for disappearing the evidence. Bail application of one co-accused Ugrasen Yadav has been rejected/dismissed on merits by this Court on 31.01.2025 in MCRC No.651 of 2025 observing that at the time of strangulation of neck of deceased, he had caught hold of him. Hence, he
3 / 3 prayed that bail applicant of present applicant be rejected/dismissed.
5. Heard learned counsel for the respective parties.

Considering entire facts & circumstances of the case, nature of allegation, submissions of counsel for the parties, particularly the submission that present applicant is the main accused in this case as at the time of murder of deceased he has strangulated his neck and, thereafter, with the help of other co-accused persons have transported the dead body of deceased to the Rangadipa forest for disappearing the evidence, further considering that bail application of one co-accused Ugrasen Yadav has been rejected/dismissed on merits by this Court on 31.01.2025 in MCRC No.651 of 2025, I am not inclined to release the applicant on bail.
