The petitioner is apprehending his arrest in connection with Purvi Tundi PS Case No.26 of 2025, for offence registered under section 274, 275, 318(4), 336(3), 3(5) of BNS, 2023 and section 47 (a) of Excise Act, pending in court of learned Judicial Magistrate, First Class, Dhanbad. 3. Learned counsel for the petitioner submits that petitioner is owner of the Scorpio vehicle being registration no.JH10DA2942 and he submits that the same is being driven by driver and the allegation is made that foreign liquor has been recovered from the vehicle in question. He submits that the petitioner has been implicated only on the confessional statement of the driver of the vehicle in question. He submits that petitioner has received notice under section 35(3) of BNSS, 2023 and has also complied the same. 4. Learned State counsel opposes the prayer and submits that petitioner appears to have criminal antecedent disclosed in the impugned order of the learned Sessions Judge. 5. Considering that petitioner has complied notice under section 35(3) BNS, 2023, the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on such terms and conditions and sureties as learned court may deem fit and proper. 6.
